Ofcom, the UK’s communications regulator, has kicked off an investigation into Aylo, the owner of Pornhub, to see if they’ve done their homework regarding age verification processes. This scrutiny comes in light of the Online Safety Act (OSA), which mandates that platforms hosting adult content must implement robust age assurance to confirm users are over 18. However, it’s left up to the companies themselves to decide how they’ll carry out these checks.
During the investigation, Ofcom plans to evaluate how Aylo has set up its age verification processes and whether they have taken the necessary precautions. The Director of Enforcement made it clear: “We expect tech firms to ensure age checks are highly effective before introducing them. Anything less could leave children at risk.”
It’s crucial to note that Ofcom had previously lauded Apple’s age verification technology, calling it a significant win for children and families. However, they also express concerns that platforms like Pornhub may host harmful or illegal content, including disturbing instances of child sexual images, if their age checks aren’t up to snuff. The regulator is keen to ensure that such sites adequately prevent minors from accessing inappropriate content.
Under the OSA, Ofcom has the authority to impose hefty fines on non-compliant companies, which can reach up to £18 million or 10% of their annual global turnover—whichever is higher. This investigation is just the latest in a series of confrontations between the regulator and one of the world’s most prominent adult content platforms, as they strive to fulfill their responsibility to protect minors.
