Prince Harry, along with six other high-profile individuals, is facing a staggering legal bill of up to £34.5 million following a ruling by a High Court judge regarding their failed privacy case against the publisher of the Daily Mail. The list of claimants includes notable names like Sir Elton John and Liz Hurley, who now must cough up an initial payment of £9.54 million by the end of next week to Associated Newspapers Limited (ANL).

The judge, Mr. Justice Nicklin, characterized this case as exceptional, noting it was one of those rare instances where the claimants are burdened with costs far beyond what was initially agreed upon before the trial commenced. He did not hold back in his criticism, describing the claims presented as “unreasonable to a high degree”. The judge went on to express his concerns over the excessiveness of the claimed costs, stating that a demand for over £34 million seemed excessive on its face and raised significant doubts about whether all expenses claimed by ANL were justifiably incurred.

Interestingly, he chose not to impose a cap on the costs that Associated could recover, suggesting that such a limitation might not be appropriate. This decision reflects the serious implications of the allegations made by the group of seven claimants. In his comments, the judge stressed the importance of clarity in legal allegations, indicating that if a party no longer stands by certain claims, those allegations should be withdrawn explicitly and in clear terms.

Among the group of claimants are Doreen Lawrence, Sir Simon Hughes, Sadie Frost, and David Furnish. In their statement released after the ruling, the individuals expressed their disappointment, saying, “We came to court seeking justice and accountability. But we have received neither.” They lamented the situation further, indicating their discontent with the judgement.

On the other hand, ANL had requested an interim payment exceeding £9.9 million ahead of upcoming hearings to thoroughly assess legal costs. However, the lawyers representing the claimants argued that the initial payment should be around £7.9 million. Justice Nicklin had previously set the deadline for the interim payment on August 28. In civil cases like this one, it is customary for the losing party to cover the “reasonable” costs incurred by the winning side.
